That Emanuel lived with the declarant for several years at the request of the mother, who even gave her a power of attorney before a notary which she no longer has a copy of, because she was both physically and mentally ill..." and also the declarations of the minors D.P. and Emanuel FROUMAN which can be found on pages 1454/1456 and 1457/1458, respectively, which explain the existing relationship between these persons and, most importantly, describe the continual separation from the family group.

Introduction

This is the June 28, 1993 order of Judge Julio Manuel Cámpora in the case: Tribunal de Menores de Mercedes - Cause number 32.202. In this order, Judge Campora requested the intervention of Federal Judge Roberto Marquevich. Judge Marquevich then reopened a 1989 case and began a new one that eventually resulted in police raids of 10 Family Homes in Argentina on September 1, 1993.

AUTOS Y VISTOS:

I.-Los constancias de la presente causa n°32.2O2.-rotulada:"FROUMAN EMANUEL Y 0TRO S/ ART 10 DE LA LEY 10067 -General Rodríguez", que fuero iniciada por denuncia de don ARTURO ODILO GODOY en representación de RUTH ELAIN MC KEE DE FROUMANN contra don STUART HARRIS BAYLIN por retención de los menores causantes -EMANUEL, D.P. , J.M., y M.Q de los. que la poderdante es progenitora (v. fs partida de nacimiento agregada a fs. 89/92 en fotocopia certificada).Explica los fundamentos y acompaña el instrumento publico que lo habilita en el rol invocado, como así también, profusa documentación que, según aquél , demostrarla el grave daño que se le estará infringiendo a los ahora buscados (vgr : denuncia de fs. l., lvta, 2,3,4/14,26/50,53/93,100/131).


También en la presentación recordada "ut-supra" refiere él denunciante que Stuart Harris Baylin es miembro de una organización denominada "La Familia" entre otras denomina­ciones, en donde los hermanos Froumann se hallarían retenidos.


II.- Y CONSIDERANDO:


A) Que en la larga investigación efectuada por este pretorio- y que no ha concluido- en procura del paradero de los hermanos FROUMANN (se ha restituido a su progenitor a dos Emanuel David y D.P.) se ha advertido la existencia de conductas que, indudablemente no pueden soslayarse, en tanto y en cuanto infringen claras disposiciones del Código Penal, de la Ley Nacional 23.849 (Convención sobre los derechos del Niño) ley 23054 (Convencíon Americana sobre Derechos Humanos llamada pacto de San José de Costa Rica, de la Ley 10.067, entre otros cuerpos legales y que, sin duda, merecerá la pertinente activdad procesal de Ios órganos jurisdiccionales competentes, a fin de establecer ya no solo la existencia y responsabilidad de conductas típicas,sino también la consecuente sanción, no sólo del denunciado,sino como se verá, a la organización identificada, pues resaltan violatorias de derechos fundamentales de la persona.


B) En efecto, simpáramos en los términos de la denuncia de fs. 1 y ccs con los de las ampliaciones de fs. 96/97 vta, existenten párrafos tales como— cuando se afirman los excesos del grupo calificados por Godoy, para con los miembros; como así también de los padecimentos de la progenitora para recuperar a sus hijos, de donde resulta fácil concluir que constituyen conductas típicas, toda ver que atentan con lo dispuesto por los arts.146, 147, 148 y 149 del Codigo Penal; la progenitora reclamante se hallaba en el ejercicio de la patria potestad, como así también en idéntica, situación se hallaba y se halla el progenitor don Cary Lewis Froumann. (vide fojas ya citadas como así también las presentaciones del padre que glosan a fs. 1477,1408, 1502,y 1503 debiéndose añadir que el claro dictamen de la Señora Aserora de Incapaces que conste a fs. 1508, en especial el prime:- párrafo).


Por otra parte, a mayor abundamiento y para fundar lo expuesto en el párrafo anterior, lo que expresa judicialmente el propio BAYLIN, es significativo en cuanto a su valor proba­torio cuando a fojas 1451 afirma: - ..."que el año parado el dicente junto a los cuatro menores FROUMANN se dirigen a Paraguay porque al dicente le gusta el lugar y había posibilidad de misionar en un campo de misión muy receptivo en la palabra de Dios, ubicado en Asunción, interrogado por el domicilio exacto, manifiesta que antes de contestar prefiere hablar con su abobado, que espera que esta respuesta no afecte su testimonio. Interrogado para que diga cómo se enteró el dicente de la existencia de estas actuaciones dice que le avisaron urgente de la Hermandad que los chicos eran buscados por este Tribunal a raíz de una dnuncia. - Que luego de de esto, el dicente se traslada a Paraguay con los cuatro hijos de Ruth. - Que ahora también miémbros de la Hermandad de Argentina, le avisaron que viniera con todos los chicos para enfrentar la situación, que el dicente arriba a Pilar el día 5 ó 6 de abril con los cuatro menores FROUMAN que ante el pedido de comparendo al juzgado el dicente decide presentar a dos de Ios hijos de FROUMAN, pero la intención era de presentar a todos. Que vinieron con los dos más grandes para ver qué es lo que' estaba pasando por cuánto tenían dudas de lo que pasaba. Interrogado'para que diga exactamente donde se hallan los dos menores M.Q. y J.M. FROUMÁN dice: Que vinieron de Paraguay y se hallan en casa de un amigo, interroga do para que diga la dirección e identidad del amigo, manifies­ta que antes de dar esa respuesta necesita hablar con su aboga do para que lo aconseje..."


En este aspecto el art. 8 de la ley 23.849 resulta sumamente explícito, pues la conducta antes descripta viola flagrantemente lo requerido por la ley, cuando taxátivamente establece en el citado articulo que "1- Los estados parte se comprometen a respetar el derecho del niño a preservar su identidad, incluido la nacionalidad, nombre y relaciones familiares de conformidad con la ley sin injerencias ilícitas".


Tal es lo ocurrido con los FR0UMAN ya que en síntesis, no se ha preservado sus identidades, en tanto y en cuanto se lo pri­vó de ácercarae a sus padres y a sus relaciones familiares, por el contrario se las dificultó, en tanto que no pudieron visitar a su madre antes de morir. Más también se infringió el. art.9 de la ley 23.849, toda vez que los separó de los padres, como ha quedado perfectamente acreditado "ut supra", a juicio del sus­cripto. Ni qué hablar de las infracciones a las normas conte­nidas en los arts. 9, párrafo 3ro., 11, 12, 13, 14, 16 de la -ley 23.849 entre otros, las violaciones, en éste sentido,"a lo menores FROUMAN, están profusamente documentadas en el "sub-examine". Más aún y como se verá las manifestaciones judiciales de BAYLIN, son claras al respecto.


En este punto cabe apuntar qué la mentada declaración judicial de BAYLIN éstáe corroborada por la de­claración -también judicial- de doña SUSANA CLARA BOROWIK; cuando a- fs. 14Í7/1448 afirma: "que por dichos del Sr. BAYLIN, sabe que vinieron a la Argentina, loa cuatro menores a la Argentina, que dos de ellos, el Sr. BAYLIN los dejó en casa de unos amigos del SR. BAYLIN, no pudiendo precisar ni identidad ni domicilio¡ mientras que los otros dos menores fueron presentados a éste juzgado el día de ayer (Martes 13 de abril). Que durante su estadía en la Argentina, los dos menores Emanuel y DPF ante junto al Sr. BAYLIN se encuentran en Pilar en el domicilio de la deponente. Que Emanuel vivió varios años junto a la dicente a pedido de la progenitora del mismo que incluso-le otorgó un poder ante escribano el cuál ya no tiene más copia en virtud de que la madre de los menores se encontraba muy enferma tanto física como mentalmente...", como así también con las declaraciones de los menores DPF y Emanuel FROUMAN que se glosan a fojas 1454/1456 y a fs. 1457/1458 respectivamente, quienes coicidentemente explicitan la relación existente entre estas personas y, lo que es fundamental, el periplo efectuado alejado siempre del grupo familiar.


Todo lo expuesto, en este tópico, hace que formen sincera convicción en el suscripto en cuánto a la responsabilidad de las personas mayores citadas más arriba por las conductas típicas que afectaron y afectan a los menores aquí encartados durante muchísimo tiempo -muchos años- y que necesariamente habrán de ser valorados judicialmente por lo magistrados procesalmente competentes, como así también valorar a la luz de los elementes expuestos y que se expondrán "infra" la actividad de esta organización, por resultar insoslayable.


C) Como se habrá advertido y como se expresó las conductas objeto de investigación no sólo pueden atrbuirse o reducirse a dos' o tres personas.


En efecto, está palmariamente probado que existe una "organización" llamé como se llamen -y que ellos mismos admiten- que ha afectado y afecta a personas o individuos mayores y menores de edad.- (Vide, sólo por caso, declaraciones testimoniales de fojas 1210/1221) a lo que debe anexarse: 1- El procedimiento realizado en la ciudad de Rosario Pcia. de Santa Fé, por la Sra. Juez de Faltas de la Segunda Nominación Dra. Liliana PUCCIO cuyo pronunciamiento, que en fotocopia se glosa a fs. 1193/1207 vta, es claro, .nítido en: cuánto al tipo de organización, decisorio avalado por loa secuestros efectua­dos y que este pretório ha podido comprobar personalmente.


2- La constancia recibida de doña RITA MC KIE, tía de los meno­res involucrados en éstos actuados, que-relata en forma muy grafica las características de está organización sus intenoionea y las conductas desarrolladas por las mismas y que constituyen, en definitiva, delitos contra 1a honestidad (violaciones, estu­pro) y/o contra la propiedad (defraudaciones y estafas) (Vide- fs. :l223/l226:. Cabe añadir en este acápite que lo expresado en perfectamente, con lo que se ha expresado hasta aquí como también con la documentación de la organización glosada en este expediente.


3- Instrucciones del referente máximo de la organización DAVID BRAND BERG o también llamado MOISÉS DAVID-o simplemente M0- en cuanto a la organización celular de la misma, las medidas de seguridad a adoptar ante procedimientos de la autoridad publi­ca, como así también las supervisión que habrá de desarrollar en las distintas oficinas de la organización (V-f s.1242)


4- Declaración testimonial de don EDUARDO LAUCE glosada a fs. 915/944; 957/959 acta de reconocimiento de lugar por parte de éstemismo testigo de fs.961/962, -fue ex-integrante de la organización- relata pormenorizadamente la actividad de ésta que -resulta en muchos aspectos violatorias a normas del derecho penal e inclusive a la ley de estupefacientes (Ley 23.737) ver -ampliaciones testimoniales del nombrado de fojas 1604 a 1608 -


5- De la nómina de material secuestrado en la localidad de Ro­sario, Pcia, de Sta. Fe. de fojas;864/867 que permite extraer entre otras conclusiones; la permanencia de la organización, en el tiempo, es decir, dede su asentamiento en el territorio ar­gentino hasta la fecha, como así-también el nombre de personas que se afincaron en distintos lugares, rotando permanentemente.


6- Informaciones de fs. 1127/1128 respectó de distintos procedimentos judiciales de donde se extraen nóminas de personas de nacionalidad norteamericana vinculadas a la organización.


7- Pericia efectuada a fs. 893/914 por el Dr. Héctor Navarro sobre el materia secuestrado en el proceso en trámite ante el juzgado de faltas de la ciudad de Rosario ya citado, que ilustra sobradamente la actividad de la organización, de vital importancia para el "sub-exámine".


8- De la voluminosa glosada a éste proceso, tales oomo la de fs. 233/295r 365, 369, 37O/37Ovta, 372/373 perteneciente, indúdablemente, a la organización, que ameritan lo antes expuesto.


9- De los informes de fojas 379/380, 395, 398/399, 405, 421-442/444; 447 que ilustran respecto de las características que presentan los distintos inmuebles locados por la organización, donde conviven niños y mayores-como así también de los vehículos que utilizan, mereciendo especial atención las medidas de seguridad adoptadas en prevención de procedimientos e inclusive la existencias de guardias armadas.


10- De la presentación de don ALFREDO SILIETA glosada a fs. 809 816 que describe con suma precisión el "modus operandi" de la-organización.


11- Del trabajo de investigación efectuado por el Licenciado BAAMONTE JOSÉ MARÍA, que establece las características, formas y modos del trabajo psicológico a que son sometidos los inte­grantes con especial referencia a menores de edad -inclusive a muy corta edad- para su estructuración mental (Vide- fs. 153/ 183).


12- De los expedientes tramitados ante el juzgado en lo crimi­nal N 2 del Departamento Judicial de Mar del Plata (B), el juzgado federal con asiendo en la ciudad de "Bahia Blanca (B), y-el juzgado N 31 Secretaría 115 de la Capital Federal, que en fotocopia corren glosados por cuerda, de los que se desprenden la comisión de delitos perpretados por los integrantes de la organización resultando víctimas menores de edad captados por aquélla gra. violación sexual, infracción a la Ley 23.737, etc.


Esta enumeración que no es taxativa sino meramente ejemplificativa lleva al suscripto al convencimiento que el grupo de personas que constituyen las organización ya señalada presenta todas las características que la ley fondal califica de asociación ilícita.


En efecto y por todo lo que se lleva expresado permiten inferir la existencia de una gran cantidad de delitos a modo de ejemplo: violación sexual, estupro, ocultamiento de menores, defraudación, reducción a la servidumbre, privación ilegal de la libertad, tenencia de estupefacientes, falsificación de documentos, que necesariamente habrán de ser investigados, como ya se expresó; pero que a juicio del suscripto es indudable que existe en la organización un girado de perma­nencia que, manifiestamente y de un modo incuestionable, permite advertir un concierto de voluntades para la reiteración de hechos ilícitos. No otra puede ser la conclusión entonces, an­te la enumeración de conductas efectuadas más arriba y que necesariamente deben ser sometidas al pretorio que indique la ley procesal. Por otra parte y en cuanto al razonamiento utilizado para arribar a ésta conclusión es el que surge de la doctrina y jurisprudencia que existe al respecto. (Vide:NUÑEZ, "Derecho Penal Argentino" Tomo V, iág.235; SOLER, S. "Tratado...". Tome IV, pág.6O8. edic. 1970; SOBA en DJBA.Ac.25.448, t.119, pág. 577, entre muchos otros.)


III. POR ELLO: En virtud de lo expuesto precedentemente, lo dispuesto por los arts. 10, 12, 14, 71 in­ciso 4to. del CPP, en función del art. 89 de la ley 10.067 y le dispuesto a fs. 1507, RESUELVO: 1- Insistir con la intervención del Sr. Juez Federal con asiento en la ciudad de San Isi­dro, Dr. Roberto José Marquevich y sin perjuicio de la competencia definitiva. 2- Remitir al magistrado antes mencionado fote-copia de laa actuaciones aludidas en éstepronunciamiento a buí efectos. 3- Ratificar lo efectuado por la instrucción. Notifiquese. Líbrense las órdenes del caso.

I. WHEREAS, IN VIEW OF THE PRESENT PROCEEDINGS:

This case number 32.202 titled: "FROUMAN EMANUEL AND OTHERS RE ARTICLE 10 LAW 10067- General Rodriguez" was initiated by the complaint of Mr. ARTURO ODILO GODOY in representation of his sister-in-law RUTH ELAIN MC KEE DE FROUMANN against Mr. STUART HARRIS BAYLIN for the retention of the minors Emanuel, D.P., J.M. and M.Q. which the granter of power is the mother (see certified photocopies of birth certificates added to pages 89/92). In his designated role and in explanation of the fundamentals, he accompanied the public instrument with profuse documentation that, according to him, demonstrates the grave harm that is now being done to the children being sought by this tribunal. (see complaint of pages 1, 1vta, 2,2, 4/14, 26/50, 53/93, 100/131).

In the presentation he also notes "ut-supra" that Stuart Harris Baylin is a member of an organization known, among other names, as the "The Family" in which the Frouman children have been retained.

II. AND CONSIDERING:


A) That in the long investigation, which has not yet concluded, by this court, to locate the FROUMAN brothers (two of the children, Emanuel David and D.P. have been returned to their father), it has become aware of the existence of conduct which undoubtedly cannot be tolerated in that it clearly infringes the articles of National Law 23.849 (Convention On The Rights of The Child), Law 23054 (American Convention On Human Rights called Pact of San Jose of Costa Rica) and Law 10.067, among other legal bodies, and which undoubtedly deserves the pertinent procedural activity of the organs of competent jurisdiction to establish not only the existence and responsibility of typical conduct but also the consequent sanction, not only against Stuart Harris Baylin but also, as will be seen, against the identified organization as they have violated the fundamental rights of people.


B) There are paragraphs in the complaint of pages 1 and others and the amplifications of pages 96/97 which affirm the excesses of the group as characterized by Godoy and also the suffering of the mother in the attempt to recover her children, in which it is easy to to conclude that they constitute typical conduct as related to articles 146, 147, and 148 of the Penal code; that the mother was trying to exercise her fundamental parental rights ("patria podestad") and that the father, Mr. Cary Lewis Froumann was and is still in the same situation as the mother (see the pages already cited as well as the presentations of the father on pages 1477, 1488, 1502, and 1503 and we must add the clear report of the Assessor of Incapables on page 1508, especially the first paragraph).


To establish the foundation for what is expressed in the previous paragraph, what the own Mr. BAYLIN expresses judicially has significant evidentiary value when at page 1451, he affirms: ..."That last year the declarant went to Paraguay with the four Frouman minors because the declarant liked the place and there was the possibility of being missionaries on a missionary field, located in Asuncion, very receptive to the word of God. Asked for the exact address, the declarant says: That before answering he would prefer to consult with his lawyer. That he hopes this response does not affect his testimony. Asked to state how he became aware of the existence of these proceedings, he says: That directors of the fellowship advised him that the children were being sought by the court on the basis of a complaint. That the declarant then came from Paraguay with the four sons of Ruth. Also that now members of the fellowship here in Argentina advised him to come with all the children to confront the situation. That the declarant arrived in Pilar on the 5th or 6th day of April with the four minor Frouman children. That with the order to appear before the court, the declarant decided to first present two of the sons of Frouman but that the intention was to present them all. That they came with the two older ones to find out what was happening as they had doubts about what was happening. Asked to state exactly where the two minors JMF and MQF are, he says: That they came from Paraguay and stayed in the house of a friend. Asked to state the address or identity of the friend, he says: That before giving that response he needs to speak to his lawyer and get advice..." In this aspect, article 8 of law 23.849 is explicitly clear, because the conduct described flagrantly violates what the law requires, when the cited article states that: "1. States Parties undertake to respect the right of the child to preserve his or her identity, including nationality, name and family relations as recognized by law without unlawful interference."

All this gives this Court a sincere conviction regarding the responsibility of the adult persons cited above for the typical conduct which affected, and continues to affect, the Frouman minors for a very long time - many years - and which must necessarily be taken into account by the magistrates of competent jurisdiction and also bring to light the exposed elements and explore "infra" the activity of this organization.


C) As has been noted, the conduct which is the subject of this investigation cannot be attributed to only two or 3 people.

This Court has proved that there is an "organization," whatever it may be called, and which, as they themselves have admitted, has affected and continues to affect persons or individuals, both adults and minors. See the testimony on pages 1210/1221 to which must be added:


1. The case in the city of Rosario, Province of Santa Fe, by the Judge of Faults of the Second Nomination, Dr. Liliana PUCCIO whose pronouncement, photocopies of which are to be found at pages 1193/1207, regarding the type of organization this is and the seized material which this court has been able to personally verify.


2. The evidence received from Miss Rita MC KIE, aunt of the minors involved in these proceedings, in which the characteristics and intentions of this organization and the conduct of its members which definitely constitutes offenses against honesty (violations, rape) and/or property (frauds and swindles) (See pages 1223/1226). It must be said that her evidence fits in perfectly with what has been expressed here and also with the documentation of the organization found in the case file.


3. The instructions of the highest leader of the organization - DAVID BRAND BERG also known as MOSES DAVID or simply MO - in regards to the cell structure of the organization, the security measures adopted before proceedings of the public authority as well as the supervision he exercises over the distinct offices of organization (see page 1242).


4. The testimonial declaration of EDUARDO LAUCE found on pages 915/944; 957/959 act of recognition of the esteemed witness of pages 961/962 - he is an ex-member of the organization and relates its activity which in many respects violates the norms of the penal right including the law of narcotics (Law 27.737). See testimonial amplifications of the named witness on pages 1604 through 1608.


5. The list of material seized in the locality of Rosario, province of Santa Fe on pages 864/867 from which can be extracted, among other conclusions: the permanence of the organization over time, that is to say from its arrival in Argentine territory until the present as well as the name of persons who joined in different places, permanently rotating.


6. Information from pages 1127/1128 in regard to various judicial proceedings involving U.S. citizens associated with the organization.

7. Expert report on pages 893/914 prepared by Dr. Hector Navarro regarding the material seized in the previously cited proceedings transmitted before the judge of faults of the city of Rosario which clearly illustrates the activity of the organization and is of vital importantance for the "sub-examination."

8. The voluminous documentation collected in this proceeding such as those from pages 233/295; 365, 369, 370/370vta, 372/373 which undoubtedly belong to the organization...


9. The reports on pages 379/380, 395, 398/299, 405, 421-442/444, 447; which illustrate the characteristics of the various properties where the organization is located, where there are both children and adults; as well as they types of vehicles they use. Worthy of special attention are the security measures they have adopted to prevent judicial proceedings as well as the presence of armed guards.


10. The presentation of Mr. AFLREDO SILIETA found on pages 809/816 which summarizes and precisely describes the "modus operandi" of the organization.


11. The work of the investigation carried out by the bachelor BAAMONTE JOSE MARIA which establishes the characteristics, forms and methods of psychological work which the members are subjected to with special reference to minors - including the very young - for their mental structuring.


12. The records transmitted before the criminal judge number two of the Judicial Department of Mar del Plata (B), the federal judge in the city of Bahia Blanca and judge number 31, Secretary 115 of the Federal Capital, photocopies of which are attached to the record, and from which can be discovered the commission of offenses perpetrated by members of the organization, the resulting victims being minors held by the organization (sexual abuse, infraction of law 23.737, etc)


This enumeration is not exhaustive but merely exemplificative. This court is convinced that the group of people which form the organization previously noted present all the characteristics which the law fundamentally classifies as an illicit association.


In effect and based on everything in the record, the existence of a great number of offenses can be inferred, for example: sexual abuse, rape, hiding of minors, fraud, reduction to a state of servitude, illegal deprivation of liberty, possession of narcotics and falsification of documents; which must necessarily be investigated as previously noted. In the judgment of this court is is undoubtedly clear that within the organization there is a grade of permanence, clearly manifested in an unquestionable form which indicates a meetings of the minds to repeat the illicit acts. No other conclusion is possible in light of the enumerated conduct noted above and which must necessarily be submitted to the process the law indicates. In regards to the reasoning used to arrive at this conclusion it is that which flows from the doctrine and jurisprudence which exists in this respect. (See: NUÑEZ, "Derecho Penal Argentino" Volume V, Page 235; SOLER, S. "Tratado..." Volume IV, page 608. 1970 edition; SCBA en DJBA. Ac. 25.447, t.119, page 577, among many others).


III. FOR THAT: In virtue of the preceding, in accord with articles 10, 12, 14, 71 (4th clause) of the CPP, and article 89 of law 10.067 and that expressed at page 1507, I RESOLVE: 1- To insist on the intervention of the Federal Judge in the city of San Isidro, Dr. Roberto Jose Marquevich and without prejudice to definitive jurisdiction. 2- To remit to the magistrate the aforementioned photocopies of the records of proceedings alluded to in this pronouncement. 3- Ratify this instruction. It is so ordered and notified. Release the orders of the case.
